David A. Marshall, Jr., of, Alexandria, identified by a former co-worker, assaulted law enforcement officers and a member of the news media, shoving and yanking the journalist down a set of stairs, and assisted other rioters in seizing police equipment, court papers say.
Just after 1:10 p.m., he "pushed and shoved" officers in the West Plaza then picked up up a yellow flag and took an officer’s baton and bag, federal paperwork details.
Marshall left the West Plaza and headed towards the Memorial Doors of the Capitol where he tried but failed to place a set of zip ties on the door handles before he successfully zip tied the doors closed with a second set of zip ties. A few seconds later, officers tried to get out of those same doors, but were prevented from doing so by the zip ties that Marshall had placed, authorities said.
Marshall then engaged in "multiple pushing and shoving" incidents with rioters and officers at the Columbus Doors of the building, including an instance where he tried to punch an officer, court papers say.
At approximately 2:40 p.m., Marshall entered the Capitol via the Columbus Doors where he pushed officers, knocking one to the ground, federal authorities said. After making his way inside, Marshall went up the Gallery Stairs and entered into the Senate Gallery. Marshall exited the Capitol via the Senate Carriage Door at approximately 2:51 p.m.
Marshall was charged in a criminal complaint filed in the District of Columbia with two felony offenses, including civil disorder and assaulting, resisting, or impeding certain officers. He was also charged with seven misdemeanor offenses, including , assault by striking, beating, or wounding, entering and remaining in a restricted building or grounds, disorderly and disruptive conduct in a restricted building or grounds, engaging in physical violence in a restricted building or grounds, disorderly conduct in a Capitol building, act of physical violence in the Capitol grounds or buildings, and parading, demonstrating, or picketing in a Capitol building.
Marshall was arrested on May 1, 2024, in Virginia and is expected to make his initial appearance in the District of Columbia on Thursday, May 2.
